Attorney Ronald E. Gluck Secures Financial Settlement at Trial for Client Injured by Snow Collapse
Settlement was reached during trial in Middlesex Superior Court
Breakstone, White & Gluck successfully resolved a mild traumatic brain injury case for our client, who was injured when heavy snow collapsed from a commercial warehouse roof onto her vehicle. During the recent jury trial in Middlesex Superior Court, Attorney Ron Gluck presented testimony from multiple expert witnesses including a neurologist and a meteorologist, who testified in support of his client’s case.
Four days into the trial, the defendants made an offer that represented an 800% increase from the pre- trial offer and the case was settled at that time, just before it would have gone to the jury for deliberation. The settlement provides significant compensation for the injuries and damages that our client suffered.
Defendants
Attorney Gluck presented evidence showing that the three defendants – the property owner, the property management company, and the company that leased the warehouse – took no action to remove snow from the warehouse roof and awning following 20 to 24 inches of snowfall. Defendants had a duty to provide a safe environment for those legally visiting the property, such as our client who was making a delivery to the loading dock at the time of her injury.
Trial and Litigation
Through extensive depositions taken during the litigation it was proven that the defendant corporations failed to establish policies for snow removal from the awning, which was located directly above the loading dock, and that none of the employees of the defendant corporations had any understanding of whose responsibility it was to remove snow from the roof. As a result, snow remained on the awning after a historic snow storm and fell onto the liftgate of plaintiff’s vehicle which slammed down onto her head, causing her injuries.
At trial, it was proven that our client was instructed to park her car directly below the awning in spite of the fact that the defendant was aware that snow had fallen from the awning onto the loading dock on prior occasions and that they knew it presented a danger to anyone standing under that awning.
The evidence presented at trial established that our client suffered a traumatic brain injury which caused multiple symptoms including memory loss, mood alteration, dizziness, headaches and involuntary movement of her limbs. She underwent a long regimen of medical treatment for her injuries.
Settlement
At the beginning of the trial, the defendants denied that they were negligent and that their negligence caused our client’s injuries. But, as the trial proceeded and Attorney Gluck presented evidence, the defendants’ settlement offers grew each day until the case was settled on day four.

Our Law Firm’s Commitment to Bicycle Safety for Somerville 5th Graders and Somerville Public Schools
For the fifth year, Somerville 5th graders have met our challenge. Our lawyers are pleased to send 370 students into summer with a free bicycle helmet from Project KidSafe, our campaign to encourage safe cycling and prevent head injuries.
The students earned the helmets by completing the CYCLE Kids curriculum, which teaches bicycle safety fundamentals. CYCLE Kids is offered as part of physical education classes at Somerville public schools. Through CYCLE Kids, some students in Somerville learn how to ride a bicycle for the first time. Others gain valuable experience or take other cycling firsts – such as riding with friends for the first time or their first ride on the Somerville Community Path.
“It’s all about your brain. Your brain is going to take you through life,” Attorney Ron Gluck told 5th graders at the Benjamin G. Brown School on Monday. “So protect your brain and it’s our pleasure to give you these helmets. You earned them, through your good work in learning about safety and bicycles.”
“It’s all about safety, but it’s also the law,” Somerville Police Officer Marianne Manfra added. In Massachusetts, cyclists who are 16 years old and younger are required to wear helmets. We urge all cyclists to wear helmets.
Shawn Maguire, principal of the Benjamin G. Brown School, Sharyn Von Trapp, the 5th grade physical education teacher and Steve Simolaris, supervisor of health and physical education at the Somerville public schools, all attended the gathering to recognize students for completing CYCLE Kids. Von Trapp handed students certificates of completion, while Attorney Gluck and Officer Manfra gave students their helmets (and we are pleased to report the students already knew how to fit their own helmets and some knew enough to help friends).

Attorney Ronald Gluck Interviewed by Boston Magazine, Says Video Footage Shows Truck Driver Was Responsible for Dr. Anita Kurmann’s Death
Attorney Ronald E. Gluck is speaking about the video footage of the 2015 truck crash that killed his client, Dr. Anita Kurmann.
Twenty months after the fatality occurred, the Boston Police Department completed its investigation and concluded that the truck driver was not responsible for the cyclist’s death. The video footage, which came from a traffic camera at the intersection where the tragedy occurred, was in the hands of the police the day the incident occurred. Yet, the Kurmann family and their attorney had to wait twenty months to see the video and to obtain any witness information from the police department, Gluck said. Multiple subpoenas sent to the police were met with a refusal to produce the information until the police concluded it investigation.
“One of the most difficult aspects of the case was that Anita’s family had to wait twenty months to obtain the video footage showing how the incident occurred…Families should have the right to know the facts in these situations,” he said.
Gluck said his own investigation found that the truck driver was responsible for Kurmann’s death.
“Once we were able to obtain a copy of the video and have it analyzed by a highly qualified expert, that expert provided compelling evidence that the conclusion reached by the Boston Police Department was wrong,” Gluck said.
Within 2 months of obtaining the video and witness accounts of the fatality, Gluck was able to demonstrate that the tragedy was caused by the truck driver’s negligence and negotiated a financial settlement with the truck driver and his insurance company on behalf of Kurmann’s estate. The settlement was reached in June 2017.
Gluck added, “I have great respect for the Boston Police Department, but we believe they got it wrong in this case. The truck driver caused the fatality, ending the life of a talented surgeon and devoted family member.”
MassBike also conducted an investigation into the case and concluded that the death resulted from the truck driver’s negligence.
Dr. Kurmann, a 38-year-old endocrine surgeon from Switzerland, was a leading research scientist at Beth Israel Deaconess Medical Center and Boston University School of Medicine. She was hit on an August morning on the corner of Massachusetts Avenue and Beacon Street. The truck driver kept going, but was located out of state later that day.
Gluck has represented plaintiffs in personal injury cases for more than 35 years. He specializes in cases involving catastrophic injury and death resulting from trucking and motor vehicle collisions, bicycle and motorcycle accidents and pedestrian injuries.

Breakstone, White & Gluck Donates Bicycle Helmets to Every Fifth-Grader in Somerville
For the fourth year, Breakstone, White & Gluck was pleased to donate bicycle helmets to every fifth-grader in Somerville who completed the CYCLE Kids bike safety training. We donated 330 helmets from our Project KidSafe campaign this month, in partnership with the Somerville Public Schools, Somerville Police Department and CYCLE Kids.
Attorney Ronald E. Gluck was on hand today as fifth-graders at the West Somerville Neighborhood School graduated from the CYCLE Kids program and received their new bicycle helmets. Somerville Community Police Officer Marianne Manfra handed out certificates of completion while Attorney Gluck handed out the new helmets. Somerville Police Chief David Fallon, Somerville Police Captain Jim Donovan, Neil Holloway, a physical education teacher at West Somerville Neighborhood School, and Steve Simolaris, supervisor of health and physical education for the schools, helped congratulate the kids and say “Great Job.”

CYCLE Kids is a curriculum which teaches safe bike riding, helmet use and nutrition. It is taught in Somerville as part of fifth-grade physical education class. For the past four years, we have tried to encourage these lessons by giving each child who completes the CYCLE Kids program a helmet. It was worth our donation this year. At West Somerville Neighborhood School, the students learned about the importance of wearing a bicycle helmet and were even fitting their own!

Breakstone, White & Gluck is active in supporting cycling safety in the Somerville community. In addition to the public schools, our law firm recently donated 120 bicycle helmets to the Kiwanis Club of Somerville for its annual Bike Safety Day, which was held last weekend. We have made this donation for the past five years and are pleased to see the Kiwanis Club continue with it each year, giving children an opportunity to receive a helmet, learn bike repair and practice safe riding in the Somerville community.
Our other partners in Somerville are Shift Bicycle Collective, a community organization which promotes bicycle safety, and Groundwork Somerville, which teaches teens agricultural skills. The teens wear the helmets as they ride around between work sites across the city of Somerville each summer.
