Breakstone, White & Gluck Receives Nancy King Award for Highest Percentage of Attorneys Participating
Breakstone, White & Gluck has received the Nancy King Award for its 100 percent participation in last year’s annual Walk to the Hill for Civil Legal Aid.

The Walk was held on January 28, 2016 at the State House in Boston. Hundreds of attorneys gathered in the Great Hall to hear from Chief Justice Ralph Gants of the Supreme Judicial Court and Attorney General Maura Healey. Several past presidents of the Massachusetts Bar Association participated, including Attorney David W. White, who served a term from 2007-2008.
The attorneys were then dispatched to speak to state Senators and Representatives and urge them to fund the Massachusetts Legal Assistance Corporation line in the Fiscal Year 2017 state budget.
Last year’s campaign was successful, which should provide good motivation for even more attorneys to attend again this year. Governor Charlie Baker approved $18 million in funding for civil legal aid in the final Fiscal Year 2017 Budget of the Commonwealth. This was a $1 million increase over the prior year’s funding.
With the additional funding, the Massachusetts Legal Assistance Corporation was able to help more low-income people facing homelessness, domestic violence, gain access to health care and other legal services.
To qualify for civil legal aid in Massachusetts, a family must earn no more than 125 percent of the Federal Poverty Level (or $30,375 a year for a family of four). Despite the increase, the Equal Justice Coalition reports that legal aid organizations are still forced to turn away 64 percent of those eligible because of a lack of funding.

BWG Project KidSafe 2016: 10,000+ Bicycle Helmets Donated to Children
Breakstone, White & Gluck has completed its 2016 Project KidSafe campaign, donating nearly 5,000 helmets to children in Massachusetts this year. With help from local bicycle committees, police departments, schools and community groups, we have now donated more than 10,000 bicycle helmets over four years to help children ride safely.

Attorney Ronald Gluck Reaches $1.25 Million Settlement for Injured Motorcyclist
Attorney Ronald E. Gluck recently reached a $1.25 million dollar settlement in a case involving serious injuries resulting from a motorcycle accident which occurred in Massachusetts.
Attorney Gluck, who has successfully represented seriously injured motorcyclists for over thirty five years, obtained the full insurance liability policy limits for our client from the defendant’s insurance company.
The motorcycle accident occurred when the offending driver of a sedan made a sudden left turn in front of our client’s motorcycle, cutting off his path of travel and leaving him no room to stop. As a result he crashed into the side of the sedan, and suffered life altering injuries.
Our client, who was obeying traffic laws and was wearing proper motorcycle clothing, suffered severe injuries, including multiple fractures of his pelvis, fractures of his lower leg and an injury to his peroneal nerve which caused significant foot drop. During surgery to repair the fractures, he suffered a complication resulting in major loss of blood among other injuries. Doctors used heroic measures to stop the bleeding and save his life.
The client was hospitalized for weeks and required extensive post hospitalization inpatient rehabilitation. Due to his injuries he was unable to work for several months. When he returned to his employment as an executive at a national company, he remained on crutches and then a cane for several more months. Long distance travel was a struggle for an extended period of time.
The injury to our client’s peroneal nerve remains a lasting injury and he is required to wear a brace in his shoe to enable him to walk steadily on many surfaces. He is also unable to participate in activities such as golf and basketball as he had in the past.

Our Experience: Previous Motorcycle Accident Settlements
Attorney Gluck has extensive experience representing motorcyclists. His experience includes a $3.75 million settlement for an injured motorcyclist in 2012, which was reported as among the state’s largest verdicts and settlements that year by Massachusetts Lawyers Weekly.
In that case, the motorcyclist was critically injured when a Lexus cut into his traffic lane, causing the rider to slam into the vehicle. The motorcyclist suffered major facial fractures, a concussion, blindness in one eye and orthopedic injuries.
The client was rendered unable to work as a result of his injuries. The proof of his loss of earning capacity by use of expert testimony was critical to Attorney Gluck’s successful resolution of the case for $3.75 million. The loss of earning capacity amount claimed by our client was disputed by the insurance company’s expert, but was proven to be accurate. The case was settled at the end of an all-day mediation, which took place two weeks before the scheduled trial date.

Attorney Ronald Gluck Files Wrongful Death Lawsuit Against Truck Driver and Company in Cyclist’s Death
The family of Dr. Anita Kurmann, who was tragically hit and killed by a truck last summer in Back Bay, has filed a wrongful death lawsuit against the truck driver and the trucking company. Breakstone, White & Gluck and Cambridge Police Team Up for Children’s Bike Helmet Giveaway During National Bike Safety Month
With a donation from Breakstone, White & Gluck, the Cambridge Police Department will distribute bicycle helmets to children who need one during National Bike Safety Month.

Cambridge Police has announced its first “helmet voucher” program as part of its National Bike Safety Month initiatives in May. Police officers will specifically be looking for children who are riding bicycles without a helmet throughout May and hand them a “helmet voucher,” which can be redeemed for a free bicycle helmet at the Cambridge Police Department.
Breakstone, White & Gluck donated 140 bicycle helmets to the Cambridge Police in hopes of keeping children safe and preventing traumatic brain injuries from bicycle accidents. The donation was part of our Project KidSafe campaign, which has donated more than 10,000 bicycle helmets to children since 2013.
Massachusetts law requires any person 16 years old or younger riding a bicycle to wear a helmet. By wearing a helmet, cyclists can reduce their chance for head injury by 50 percent, according to the Insurance Institute for Highway Safety.
This is a special donation and Attorney Ron Gluck and Attorney David White joined Cambridge Police at the Cambridgeport School for an unofficial kick off last week. Here are some photos:

Study: Pedestrian Fatalities Are Rising in Massachusetts, Across U.S.
Walking, even in the crosswalk, is becoming more dangerous.
The Governors Highway Safety Association (GHSA) is projecting a 10 percent increase in pedestrian fatalities in traffic crashes across the U.S. last year. This marks the largest increase in four decades, since data was first collected.
The official tally shows an estimated 2,368 pedestrians were killed between January and June of 2015. Researchers expect annual figures to reach the 10 percent mark.
In Massachusetts, 34 pedestrians were killed during the first half of 2015, up 26 percent from 27 fatalities in 2014.
Already in 2016, there have been numerous pedestrian fatalities. WalkBoston, a non-profit advocacy group, recently reported 11 people were killed while walking in Massachusetts in January alone. The accidents were reported in South Hadley, Malden, South Yarmouth, Worcester, Roslindale, Dorchester, Reading, Framingham, South Boston, Quincy and other communities.
In at least four cases, pedestrians were tragically killed while walking in a crosswalk, where they should have special protection under Massachusetts law.
“The law is clear. Pedestrians have the right of way when crossing the street in a crosswalk or at an intersection with the “Walk” signal,” said Attorney Ronald E. Gluck, who has represented victims of pedestrian accidents in Boston for 35 years.
Gluck added, “Drivers who disobey this law can expect to face stiff consequences. They can expect to be charged criminally, especially if there is injury or death. But a police officer can charge any driver who violates the law, even if there is no injury. They can also expect to face consequences in a civil case brought by the injured pedestrian or the family of a pedestrian who was killed.

Many Pedestrian Accidents in Massachusetts Since New Year
During the first two weeks of 2016, Massachusetts has already seen several serious pedestrian accidents.
Last weekend, a 56-year-old security guard leaving work was killed in a hit-and-run accident on West Boylston Street in Worcester. Police have charged a 21-year-old man with motor vehicle homicide by negligent operation and other violations.
Last week, a 68-year-old pedestrian was killed in South Hadley, as he crossed the street in front of his home. In that case, the driver remained on the scene and police opened an investigation.
In Palmer, a 59-year-old pedestrian was killed while using a crosswalk at the intersection of North Main and Rockview streets. The pedestrian accident occurred about 5 p.m. in the day and the driver fled the scene.
Then in Cape Cod, a 19-year-old man was also killed when hit while crossing Route 28 in Yarmouth.
A few concerns for pedestrians in the winter:
Plow trucks. Last winter, at least two pedestrians in the Boston area were killed in parking lots by snow plow trucks. A 60-year-old employee at the Whole Foods store in Medford was struck and killed while walking across the store’s parking lot. A few days earlier, a Weymouth woman was hit and killed by a snow plow driver who was clearing the parking lot outside her condominium complex.
Parking lots. Pedestrians are just as vulnerable in parking lots as they are in streets. Last week, a pedestrian was hit in the South Street shopping plaza in Holyoke, in front of the Save-A-Lot supermarket.
Crosswalks. In Massachusetts, pedestrians who are crossing the street in a crosswalk or at an intersection with the “Walk” signal have the right of way. But drivers often fail to stop for pedestrians – and sometimes crossing guards. A crossing guard in Holyoke was struck by a car and injured at 8 a.m. one day last week.

Breakstone, White & Gluck Donates Bicycle Helmets at Dedham Bike Rodeo For Third Year
Breakstone, White & Gluck returned to the Dedham Bike Rodeo yesterday for the third year in a row. We were happy to donate 120 new bicycle helmets to the kids at the rodeo.

The Dedham Bike Rodeo was one of the first events we participated in after starting our Project KidSafe campaign in 2013 and we always look forward to it. It is an annual event organized by the Dedham Police Department and Dedham Parks & Recreation Department. Local children are invited to ride around at the Endicott Estate, then offered a free lunch. The Dedham Police Department raffles off free bicycles to a few lucky children. For the finale, the Dedham Fire Department brings in the hose truck and lets the kids run under the water to cool down. That was much needed yesterday, with the temperature over 90 degrees!
Attorney David W. White fitted the children for new bicycle helmets and talked to them about the importance of always wearing one. A child who wears a helmet significantly reduces their chance of suffering a traumatic brain injury in a bicycle accident. In Massachusetts, wearing a bicycle helmet is also the law for children and teenagers 16 years old or younger.
David has fitted some of the Dedham kids two or three times now over the years and it was nice to see them back, willing to wait in line on such a hot day. A lot of helmets from years past were still being worn by other kids.
Breakstone, White & Gluck donated the helmets as part of our Project KidSafe campaign, which we launched in 2013. To date, we have donated over 5,000 helmets and expect to reach 8,000 by year’s end.
Our goal is to encourage children to wear bicycle helmets and ride their bikes safely. Even though it is widely known that bicycle helmets can protect cyclists, many children still do not wear them or use ones which do not fit properly or are in poor condition.
It is important for children to wear helmets which fit properly and meet safety standards. Children are especially vulnerable to bicycle-related injuries and deaths, accounting for half of all cyclists who are treated in emergency rooms each year, according to the Centers for Disease Control and Prevention. Some 26,000 children are treated for traumatic brain injuries related to bicycling accidents.
We also encourage parents to always wear their helmets too. When children see their parents consistently wearing helmets, the use of helmets by children increases dramatically.
