As part of our Project KidSafe campaign, Breakstone, White & Gluck was pleased to make a donation of 200 bicycle helmets to the Quincy Police Department this year. Attorney David W. White visited Quincy Police Department headquarters on June 14th and had a nice opportunity to speak to members of the Quincy Police bike patrol.

Attorney Ronald Gluck Interviewed by Boston Magazine, Says Video Footage Shows Truck Driver Was Responsible for Dr. Anita Kurmann’s Death
Attorney Ronald E. Gluck was interviewed by Boston Magazine about the truck crash that killed his client, the late Dr. Anita Kurmann. Gluck said he had to wait 20 months after the truck’s collision with the cyclist to obtain the video surveillance from the Boston Police Department. While the Boston Police Department found the truck driver was not responsible, Gluck said his investigation found the truck driver caused his client’s death. Gluck negotiated a financial settlement with the truck driver and his insurance company on behalf of Kurmann’s estate in June 2017.

Twenty months after the fatality occurred, the Boston Police Department completed its investigation and concluded that the truck driver was not responsible for the cyclist’s death. The video footage, which came from a traffic camera at the intersection where the tragedy occurred, was in the hands of the police the day the incident occurred. Yet, the Kurmann family and their attorney had to wait twenty months to see the video and to obtain any witness information from the police department, Gluck said. Multiple subpoenas sent to the police were met with a refusal to produce the information until the police concluded it investigation.
“One of the most difficult aspects of the case was that Anita’s family had to wait twenty months to obtain the video footage showing how the incident occurred…Families should have the right to know the facts in these situations,” he said.
Gluck said his own investigation found that the truck driver was responsible for Kurmann’s death.
“Once we were able to obtain a copy of the video and have it analyzed by a highly qualified expert, that expert provided compelling evidence that the conclusion reached by the Boston Police Department was wrong,” Gluck said.
Within 2 months of obtaining the video and witness accounts of the fatality, Gluck was able to demonstrate that the tragedy was caused by the truck driver’s negligence and negotiated a financial settlement with the truck driver and his insurance company on behalf of Kurmann’s estate. The settlement was reached in June 2017.
Gluck added, “I have great respect for the Boston Police Department, but we believe they got it wrong in this case. The truck driver caused the fatality, ending the life of a talented surgeon and devoted family member.”
MassBike also conducted an investigation into the case and concluded that the death resulted from the truck driver’s negligence.
Dr. Kurmann, a 38-year-old endocrine surgeon from Switzerland, was a leading research scientist at Beth Israel Deaconess Medical Center and Boston University School of Medicine. She was hit on an August morning on the corner of Massachusetts Avenue and Beacon Street. The truck driver kept going, but was located out of state later that day.
Gluck has represented plaintiffs in personal injury cases for more than 35 years. He specializes in cases involving catastrophic injury and death resulting from trucking and motor vehicle collisions, bicycle and motorcycle accidents and pedestrian injuries.

Breakstone, White & Gluck Kicks Off 2018 Project KidSafe Campaign, Donates Bicycle Helmets to Children at Arlington Elementary School
Attorney Marc L. Breakstone helped deliver new bicycle helmets to Arlington fifth graders this week. He asked them to make a promise: to ride safely and always wear their helmets when riding to prevent head injuries.
“Now I’m not here to scare you. I’m here to inspire you, okay? … I want you all to be safe bicyclists,” Breakstone said.

The bicycle helmets were a surprise gift for the 50 students at Pierce Elementary School’s bike safety training. MassBike, Massachusetts Safe Routes to School and the Arlington Police Department participated.
During his talk, Attorney Breakstone spoke to the students about the impact of concussions and his experience as a personal injury lawyer who has represented cyclists who have suffered head injuries.
“A concussion can affect you for your entire life,” he said.
Tom Francis, of MassBike, also urged students to wear their new helmets. “If it’s in your garage or hanging on the wall, your helmet is not doing any good. It has be to on your head.”
Francis covered a number of safety topics, including riding on sidewalks near pedestrians, hand signals and developing a routine.
“Be predictable when you ride your bike,” he said.
Since 2013, Breakstone, White & Gluck’s Project KidSafe campaign has donated more than 20,000 bicycle helmets to children in eastern Massachusetts. We kicked off the 6th year of our safety campaign in Arlington this week. It was our fifth year supporting Pierce Elementary School, where there are no school buses. Students walk, ride bicycles or are driven by their parents.
Through Project KidSafe, we are committed to helping children and families put on bicycle helmets. From our experience as attorneys and cyclists, we know helmets are critical to preventing concussions, traumatic brain injuries and deaths. We want to prevent injuries. For the next few months, we will be working with community partners throughout the Boston area to donate bicycle helmets and educate families about bicycle safety. Each helmet meets safety standards set by the Consumer Product Safety Commission and will be fitted by one of our attorneys or community partners.

Recognized for our Project KidSafe Campaign Donating Over 15,000 Children’s Bicycle Helmets and Support for Cycling Organizations

Today, the League of American Bicyclists recognized Breakstone, White & Gluck with a Silver Level Bicycle Friendly Business award. This is a special honor, coming as we complete the fifth year of our Project KidSafe campaign, donating over 15,000 bicycle helmets to children in Massachusetts. We have distributed the helmets in partnership with over 40 community groups, local bicycle committees, police departments and schools.
The League of American Bicyclists announced 58 new and renewing businesses in its Bicycle Friendly Business program today. Breakstone, White & Gluck was one of three businesses recognized in Massachusetts and now joins 1,118 current Bicycle Friendly Businesses across the country, including local businesses, government agencies, and Fortune 500 companies that are transforming the American workplace.

Project KidSafe
Founded in 2013, our Project KidSafe campaign has donated over 15,000 bicycle helmets to children in Boston, Cambridge, Somerville and across Massachusetts. Our firm has partnered with over 40 bicycle community partners, including Massachusetts Safe Routes to School, Boston Bikes’ Roll It Forward, CYCLE Kids and Somerville Public Schools, the Kiwanis Club of Somerville and Bikes Not Bombs. As part of our Project KidSafe campaign, our attorneys participate in the National Bike to Work Day at Boston City Hall Plaza each May, distributing free helmets to cyclists who need a replacement and to workers who want to start riding. For the past four years, we have also supported Boston Bikes, a City of Boston program, and MassBike in campaigns to distribute bike lights. Massachusetts law requires cyclists to use bike lights to stay visible after sunset and before sunrise.
