Parents: Time to Talk to Teen Drivers About Safety

10528911_s.jpgWith the snowbanks nearly gone, your teen driver is likely asking for the car keys. Now is a very good time to talk to them about paying attention on the roads and following traffic laws.

Young people ages 16 to 19 are nearly three times more likely to be in a fatal motor vehicle crash than other age groups. While cell phone use is a frequent cause, there is also simple inexperience. If you are a parent, you know this conversation takes a lot of work and a lot of repetition.

We offer these safety tips for teen drivers:

  • Always wear your seat belt.
  • Keep your hands on the wheel and your eyes on the road.
  • Do not take phone calls while driving. The caller can leave a voicemail.
  • Remember that under Massachusetts Junior Operator License, teen drivers are not allowed to use cell phones behind the wheel. You cannot send texts or make phone calls. If you are caught, you may be fined and your license suspended. It is important to think about these steps for the safety of others and to keep yourself out of trouble.
  • If you must use your phone, pull off the road to a safe area. Put the car in park and remove the keys. Or ask a passenger to call or answer for you.
  • Travel with the phone in the best place to reduce distraction. If your phone ringing or lighting up with messages distracts you, set it in a bag in the backseat.
  • Remember that whatever is happening on your phone can wait, whether it is a social media post, e-mail or photo. It really can.
  • Be mindful of distractions created by loud music or intense conversation. Explain to passengers you need to limit conversation while driving.
  • Remember you cannot carry passengers under the age of 18 during the first six months with a Massachusetts Junior Operator License. The one exception is you can drive with siblings.
  • Do not look up phone numbers or GPS directions on your phone while driving.
  • Many cars have dashboard GPS systems and infotainment systems. Turn them off until you are more experienced.

Other Safe Driving Habits

  • Never consume alcohol and drive. No driver should, but you are more likely than older drivers to get in car accidents because you lack driving experience.
  • Before entering your vehicle, look around for other cars, trucks and hazards. Make sure you provide bicyclists and pedestrians extra time to pass.
  • Shift your eyes every two seconds and check the rear-view mirror every five to eight seconds. This will help you focus on driving.
  • Do not drive drowsy. If you are tired, you will be less capable of responding to potential car accidents. The Massachusetts Junior Operator License restricts young drivers from traveling between 12:30 a.m. and 5 a.m., unless accompanied by a parent. This is a good step but realize you always have to be aware of your fatigue level and make good decisions at all hours.
  • Even if you have your license, keep practicing. For instance, if you are weak backing up, practice backing into a parking space in an empty parking lot with a parent. Keep practicing because you will need these skills going forward and will not always have the time to practice.
  • There are construction work zones in many places. Be extra attentive, slow down and watch for workers.
  • Check your speed regularly and slow down. A little extra space between you and the car in front of you can make a big difference toward preventing a car accident.
  • Drive defensively. Expect the unexpected will happen and you may have to stop or change lanes.
  • Signal your intentions to turn or switch lanes early enough to give others time to prepare.
  • Do not drive on the highway on your own before you are ready.
  • Limit the number of times you drive your friends home after sports practices, to the mail or school events. Every teenager looks forward to driving around with their friends, but teens are more likely to become distracted this way.
  • Be careful in school zones and school buses. Slow down and watch out for teenagers and children walking or riding bikes. You are required to stop when school buses stop.

Safety for Pedestrians, Cyclists and Drivers

cyclist-pedestrians.jpgSafety for pedestrians and drivers was in the spotlight this winter, as Boston endured a record snow fall and everyone stood divided by the tallest of snowbanks. Now, as the snow starts to melt, cyclists are back out too and we want to take a moment to share a few safety reminders.

Safety was a priority this winter because Massachusetts saw many car accidents, even though state officials called multiple snow emergencies, and many schools closed, to keep the roads clear. We also saw at least two fatal pedestrian accidents. In Weymouth, a woman was hit and killed by a snow plow as she walked in the parking lot of her condominium complex. A 60-year-old employee at a Medford Whole Foods store also was killed, hit by a snow plow in the parking lot, leaving after his work shift.

Safety advocates made progress on protecting cyclists and pedestrians in 2014. This will serve as a strong foundation as we dig out from this harsh winter. In Boston, the city has implemented a truck safety ordinance, requiring that city-contracted trucks use sideguards and other protections aimed at protecting pedestrians and cyclists.

MassBike and other safety advocacy groups have also proposed new legislation which may get attention after this hard winter. If passed, the Bike Lane Protection Bill would make it illegal to block established bike lanes. The Vulnerable Road Users Bill would define pedestrians, cyclists, emergency personal and others as vulnerable road users and define a safe-passing distance for them.

Here are a few safety tips and facts to remember for pedestrians, cyclists and drivers:

Pedestrians

  • Pedestrian accidents are too common. On average, in 2013, a pedestrian was killed every two hours and injured every eight minutes in traffic crashes, according to the National Highway Traffic Safety Administration (NHTSA).
  • Walk on the sidewalks whenever possible. If a street only has sidewalks on one side, cross over.
  • If you have to walk on the street, walk so you are facing oncoming motor vehicle traffic. Walk as close as you can to the curb to increase the space between you and traffic.
  • Use crosswalks whenever they are available.
  • Limit use of cell phones, iPods and music players.
  • A common misperception is most pedestrian accidents happen at intersections. That is not true. Some 69 percent of pedestrian accidents occurred at non-intersections in 2013, according to the NHTSA.
  • Some 10 percent of pedestrian accidents happened off the road, in areas such as parking lanes/zones, bicycle lanes, shoulders/roadsides, driveway access and similar areas.
  • In the Spring of 2013, most pedestrian fatalities, 25 percent, occurred between 9 to 11:59 p.m., according to the NHTSA. Another 22 percent occurred between 6 to 8:59 p.m.
  • If you walk at night, purchase a neon glow vest so you stand out to traffic. Even if you never wear it, it pays to be prepared.

Bicyclists

  • Wear a bike helmet which meets the safety standard of the Consumer Product Safety Commission and properly fits.
  • Cyclists follow different rules than pedestrians. Go with the flow of traffic, traveling in the same direction as cars, on the right side of the road. Up to two cyclists can ride in the middle of the traffic lane abreast if necessary to stay safe, but you should move back onto the side of the road single file when you can safely do so.
  • State law prohibits biking on sidewalks in business districts. Not every city and town has a designated business district. But assume you are not allowed to ride on the sidewalk or ask the local police department for guidance.
  • Cyclists must use hand signals to communicate to drivers, unless it would be unsafe to do so. You can view this video to learn the proper hand signals. Cyclists should also use a bell to let pedestrians know they are approaching.
  • Watch out for dooring. This is when a car parks and the driver opens their door and hits you as you pass through. It is against the law, but it happens often.
  • You are required to use a white headlight and red taillight or rear reflector if you ride anytime from a half hour after sunset until a half hour before sunrise.
  • If you ride at night, consider purchasing a neon safety vest or clothing so you are more visible drivers..
  • If you are involved in a bicycle accident, file a police report, even if you do not think you are seriously injured at first.
  • Many drivers may not stop after cycling accidents. If you are hit and the driver does not stop, immediately contact police and file a police report.

Motor Vehicle Drivers

  • Look for cyclists and pedestrians at every intersection and yield to them.
  • Drivers must pass bicyclists at a safe distance. If you cannot, you must wait until it is safe to do so or change lanes.
  • Obey all traffic laws and signals. Look for areas designated as school zones. Reduce your speed and take extra care on these roads.
  • Do not park in bike lanes.
  • Do not use your cell phone in the car. It is against the law in Massachusetts for drivers to text and drive, but the best practice is not to use it for telephone calls or other reasons either. It only takes a few seconds to cause a distracted driving car accident.
  • A very dangerous practice is dooring. This is when a driver parks their car and opens the door without looking and hits an oncoming cyclist. It is against the law and violators can be fined. But drivers may also face a steeper penalty, a personal injury lawsuit, because cyclists can be seriously injured and the injuries can require months of recovery and hospital bills.

Honda Motor Co. Fined $70 Million for Failure to Report Injuries and Deaths

20150112_honda.jpgLast week we learned the National Highway Traffic Safety Administration (NHTSA) issued Honda Motor Co. two safety fines totaling $70 million. The fines were announced last week but had been issued before the New Year. These are the largest penalties the NHTSA could impose. With them, automakers finish the year paying $126 million in civil penalties, the most ever for one year. The amount also exceeds the total amount collected in all 43 years of the NHTSA’s operation.

Honda’s Fines

  • Honda was fined $35 million for failure to report submit early warning reports (EWR reports) identifying potential or actually safety issues. The company failed to report 1,729 death and injury claims between 2003 and 2014.
  • Honda was fined a second $35 million for failure to report certain warranty claims and claims related to its customer satisfaction campaigns, in which a manufacturer quietly agrees to fix defects on cars even beyond the normal warranty period.

Honda was ordered to submit injury reports as part of the NHTSA’s investigation on defective Takata airbags last year. Some of the drivers who died as a result of the Takata airbag defects were driving Honda vehicles. The airbag defects are linked to at least five deaths and dozens of injuries in the U.S. Automakers have recalled nearly 14 million cars with these airbags worldwide. Takata, a Japanese company, has limited its recalls to Florida, Hawaii and other warm weather states, despite pressure from the NHTSA to expand the recall nationwide.

Other Companies Which Were Fined
Among the companies the NHTSA fined last year: Gwinnett Place Nissan, Ferrari S.p.A. and Ferrari North America, Chapman Chevrolet LLC, Hyundai Motor America, General Motors Company and Prevost and Southern Honda Powersports.

Then of course there was General Motors, which was fined $35 million for how it handled a recall of more than 2 million vehicles with ignition switch problems. It also paid a separate $441,000 fine for failure to fully respond to a special order by a specified due date.

Toyota is not on the list of companies which paid civil penalties in 2014. But it paid the U.S. government a $1.2 billion criminal fine for it actions during a safety investigation.

Proposed Safety Changes for 2015
In the New Year, the U.S. Department of Transportation and NHTSA are proposing to increase the maximum fine for auto safety violations from $35 million to $300 million. The agencies also want the NHTSA to have additional authority to compel companies to recall unsafe products.

National Child Passenger Safety Week: Check for Child Seat Recalls This Year

carseat-010314.jpgThis is National Child Passenger Safety Week, when parents can get answers to common questions about driving safely with their children.

National Child Passenger Safety Week began last weekend and is observed by the National Highway Traffic Safety Administration (NHTSA) and local communities. It ends this weekend with National Seat Check Saturday.

Motor vehicle accidents are one of the leading causes of death for children in the United States. Child safety seats reduce the risk for injury if they are used properly, by more than 70 percent when it comes to infants and more than 50 percent for children age 1 to 4. But parents have long struggled with how to use them. In one study, more than 70 percent of 3,500 observed car and booster seats were misused in a way that could harm children, according to the Centers for Disease Control and Prevention (CDC).

Parents should also closely examine their child safety seat models this year. Several months ago, Graco recalled more than 6 million child safety seats, the largest car seat recall in U.S. history. Parents reported they were unable to unbuckle defective harnesses and had to cut their children out of the straps. The cause was food was getting dried up in the harnesses and causing them to stick.

Child passenger safety laws have changed over the past decade and every state now has a law for infants and children-fitting specific criteria. All but two (Florida and South Dakota) require booster seats for older children. The Massachusetts Child Passenger Safety Law requires children to ride in federally-approved child passenger safety seats that are properly secured until they are eight years old or over 57 inches tall.

Despite laws for older children, Safe Kids, a national non-profit organization, has released a new report, showing 7 in 10 parents did not know a child should be at least 57 inches or 4’9″ tall before they ride in a car without a booster seat. The organization surveyed 1,000 adults.

Check Your Car Seat Label. Become informed about the specifics of car seats. Make sure yours fits your child’s weight, size and age. For infants through age two, look for a rear-facing child safety seat. For children between ages 2 -4 or up to 40 pounds, choose a forward facing child safety seat. From age 4 to 8 or 57 inches, children should ride in belt positioning booster seats. Read more.

Buckle Up Massachusetts: State Fails to Win Top Safety Score from Watchdog Organization

seatbelt-2-200.jpgWhen it comes to seat belts, Massachusetts may need to buckle up and strengthen its laws if it wants a higher rating from one safety organization.

Massachusetts was among 29 states which received a secondary rating from the Advocates for Highway & Auto Safety in its annual report released in January. In the 2014 “Roadmap of State Highway Safety Laws” report, the group gave 10 states – including Rhode Island – its highest rating. Poor ratings were given to New Hampshire and 10 other states.

Massachusetts received strong marks for teen driving laws, but fell short in other areas, including its lack of a primary seat belt law.

In Massachusetts, the law governing seat belt use is M.G.L. c. 90 § 13A. Drivers and passengers are required to wear seat belts, but police can only issue citations for violations if they pull over a vehicle for another offense. Each driver and occupant over age 16 shall be fined $25 for failing to wear a seat belt. Drivers can be fined for occupants 12 to 16 years old. Children 12 and younger must follow the Massachusetts Child Passenger Safety Law, M.G.L. c. 90, §7AA.

Across the country, 33 states and the District of Columbia have primary enforcement laws for front seat passengers and 17 have these laws for back seat passengers.

The National Highway Traffic Safety Administration (NHTSA) has long cited seat belts as the most effective way to reduce the risk of death in a car crash. In 2012, the agency credits seat belts with saving 12,174 lives in auto accidents.

In Massachusetts, we have fiercely debated our seat belt laws. Gov. Michael Dukakis signed a mandatory seat belt law in 1985. But a year later, opponents organized a citizen campaign and repealed the measure at the ballot box.

While today’s law requires drivers and passengers to wear seat belts, in 2009 the NHTSA surveyed seat belt use across the country and ranked Massachusetts last for compliance.

At that time, 67 percent of occupants of vehicles in Massachusetts were wearing seat belts compared to the national average of 83 percent among other states.

Recent state figures report a greater compliance rate. The 2012 Massachusetts Safety Belt Usage Observation Study, prepared for Massachusetts Highway Safety Division reported a 73 percent compliance rate in 2011, an increase from 50 percent in 2000.

Attorney Ronald Gluck of Breakstone, White and Gluck stated that “fortunately, over the years, our firm has seen a significant reduction in cases where the injuries are directly tied to the failure of occupants to wear seat belts. ”

Are You Ready for Winter Driving?

car-snow-200.jpgWinter is almost here! We have already seen the first snow flurries in Massachusetts, and it is time for drivers to get prepared for winter driving.

Each year, over 1,300 people are killed and more than 116,800 people are injured in car crashes on snowy, slushy or icy pavement, according to the U.S. Department of Transportation. During snowfall, nearly 900 people are killed in accidents and 76,000 are injured.

Stay safe on the roads this winter. Our Boston car accident lawyers share these tips:

Slow Down! Reduce your speed. When it snows, if you are traveling the speed limit, you are probably traveling too fast for road conditions and are at risk for causing a car accident.

Leave Extra Distance. It takes longer to stop on snowy and icy roads. Increase your following speed to 10 seconds.

Clear Snow and Ice. Make sure your car and windows, including your headlights and turn signals, are free from all snow and ice when you drive.

Gas. Keep your gas tank at least half-full throughout the winter.You will be prepared in case of a serious storm, and you can make sure your gas lines do not freeze up.

Check Your Tires. Inspect your tire tread to make sure your tires are ready for winter. Also, check your tire pressure once a month in the winter.

Exhaust. Keep your exhaust pipe clear of snow.

Practice After the First Snow Storm. On the first icy, snowy day, find a big parking lot that is empty and practicing your skills for handling skids.Teach the new drivers in your home to control a skid the first chance you get.

Highways. If the roads are still being cleared, travel in the lane which has most recently been plowed and avoid changing lanes.

No Cruise Control. Do not use cruise control on slippery roads.

Pedestrians. Remember you may not be able to see pedestrians around snow banks. Reduce your speed and take an extra minute to check for them at intersections.

Check Your Auto Insurance. Check your auto insurance policy. Many people do not have enough insurance to pay their medical bills if they were injured on the road. Car Accident Study: Drivers Who Use Cell Phones May Show Other Risky Behaviors

car-night-180.jpgA new study raises the question of whether driving while using a cell phone is the safety risk or a symptom of a larger problem: an aggressive driver with dangerous habits.

Researchers at the Massachusetts Institute of Technology (MIT) found drivers who engaged in frequent cell phone use are higher-risk, even when their phone is out of use. The researchers studied the behavior of 108 Greater Boston drivers. About half admitted to frequent cell phone use while the others said they rarely talked behind the wheel.

The frequent cell phone users tended to drive faster, changed lanes more often and spent more time in the far-left lane. They were also more likely to accelerate rapidly and slam on the breaks.

The data supports the focus on cell phone use: The National Safety Council (NSC) estimates about 1 of 5 car accidents involve drivers who were on the phone.

But researchers say even as the number of cell phones has increased nationwide, the number of car accidents has not, leading to one possible conclusion that drivers who talk behind the wheel are also engaging in other risky behaviors.

Massachusetts is among 39 states which have banned texting while driving. Ten other states ban talking on the phone unless a driver uses a hands-free device. Recently in Massachusetts, lawmakers have considered full cell phone bans to reduce car crashes.

Researchers are investigating whether the answer lies beyond new laws. They are considering retraining programs for drivers which discourage cell phone use and provides warning about other bad habits. Focus is also on auto collision warning systems or sensors which identify when cars cross a lane.

Car Accident Risk Increases with Independence Day Holiday Travel

car-accident.jpgThis year, the Fourth of July holiday travel is projected to increase, making it particularly important to plan and take precautions before getting behind the wheel. The AAA auto club expects a 4.9 percent rise in cars traveling 50 miles or greater. The travel will be spread out over the six days between Tuesday, July 3 and Sunday, July 8.

The expected Independence Day holiday travel volume will tie the past decade’s previous high mark set in 2007 and represents a near 42 percent increase from 2009.

The busiest days were expected last Friday and this coming mid-week. The National Safety Council estimates the U.S. will see 173 car accident deaths between Tuesday night and Wednesday. Some 17,300 serious personal injuries requiring medical attention were also expected.

The Boston car accident lawyers at Breakstone, White & Gluck urge drivers to be safe, plan and take precautions with these tips:

Fuel Up. Always fuel up your car before you start traveling.

Seat Belts. Seat belt use saved more than 75.000 lives from 2004 to 2008, according to the National Highway Traffic Safety Administration.

No Cell Phones. You reduce your ability to respond to potential accidents when you are talking or texting. To avoid temptation, the best plan is to ask someone else to hold your phone.

Travel Off-hours. The mid-week holiday provides more options for traveling. Consider returning Thursday or Friday rather than Saturday or Sunday.

Slow Down. Make sure you are providing adequate room between yourself and the car in front of you.

Tolls. Consider signing up for a pre-pay toll program before your trip. This will allow you to use a greater number of lanes at the toll booths and reduce your chance for a car accident.

Use Your Air Conditioning. In addition to keeping everyone in the car comfortable, it will allow you to stay more alert while driving.

Tires. Make sure your tires are properly inflated before you travel a long distance. Underinflated tires can cause tires to overheat and result in a car crash.

Battery. If your car battery is over 3 years old, have it checked before you travel. Heat can cause your battery to fail.

Traveling with Children. Supply children with books to flip through or similar low-key toys to keep them occupied so they will not distract you while driving.

Drowsy Driving. If you are having trouble sleeping and drive, you could cause a serious car accident. Ask someone to take the wheel.

Emergency Kit. Stock an emergency kit with water, non-perishable food, a flashlight with extra batteries, jumper cables, road flares, a first aid kit and neon vests for all your passengers. This will make you visible to other drivers if you must exit your vehicle.

Pedestrians and Cyclists. Whether you are traveling to your holiday destination or running out to the store once you have arrived, watch out for pedestrians and cyclists on the shoulders of the road and crossing.

Motor Vehicle Accidents Increase When Teen Drivers Carry Teen Passengers, Study Reports

carcrash.jpgAmong drivers, teenagers have long been known as the most likely to be involved in car accidents. But a new study released by AAA’s Foundation for Traffic Safety is now quantifying how much that risk increases when teen drivers travel with other teens.

The study relies on federal fatality statistics and shows the risk for a fatal motor vehicle accident increases by almost half when a 16- or 17-year-old driver has one teen passenger in the car. The risk for a motor vehicular fatality doubles with two passengers and quadruples with three or more.

During the past decade, many states have implemented graduated licensing laws which have increased training requirements for new drivers, while also placing restrictions on passengers and hours of operation.

The Massachusetts’ junior operator license law prevents drivers from carrying passengers under the age of 18 during the first six months of having a license. There is an exception for siblings.

The law further bans teen drivers under 18 from operating between 12:30 a.m. and 5:00 a.m. unless accompanied by a parent or guardian.

In 2010, the state of Massachusetts strengthened junior operator restrictions when it banned the practice of texting while driving for all drivers. While most drivers face a fine for first-time offenses, teens face heavier penalties of fines, license suspensions and are required to attend retraining classes.

Drivers age 18 to 20 report the most phone use during motor vehicle accidents, according to the National Highway Traffic Safety Administration (NHTSA). The age group is three times more likely to report they are reading or sending a text message or e-mail during a car accident than drivers over age 25. Reports of texting while driving drops significantly as age increases, the NHTSA figures show.

We urge parents to strictly enforce junior operator laws in their homes. In addition to helping teenage drivers get experience without distraction, preventing use of a family car in violation of the junior operating laws is one way to avoid claims for negligent entrustment of an automobile.

April is Distracted Driving Awareness Month

textingincar.jpgText messaging while driving creates a car accident risk 23 times worse than driving while not distracted, according to the U.S. Department of Transportation. This statistic is alarming because while texting behind the wheel is a preventable act, more people than ever are using cell phones while driving, to make calls and text.

Texting while driving is one of the behaviors being highlighted during April’s Distracted Driving Awareness Month: One Text or Call Could Wreck It All. Many states are using the month, sponsored by the DOT, to increase awareness and law enforcement efforts.

In 2010, over 3,000 people were killed in distracted driving crashes. in the U.S. Distracted driving behavior includes texting while driving and cell phone use, but also other activities that take a driver’s attention off the road. This can include: putting on makeup, grooming, talking to others in the car and GPS use. DOT officials ask drivers to consider distracted driving behavior as any behavior that takes your hands off the wheel, your vision off the road or your mind off driving.

But cell phone use gets the most attention. As cell phone users have increased over the years, so have car accidents related to texting while driving and talking on a cell phone. Today, 9 out of 10 Americans own a cell phone and users are getting younger and younger. The National Literary Trust reports 85 percent of children in this country own cell phones, compared to the 73 percent who own books at home.

Some 37 states, including Massachusetts, ban texting while driving. Ten states, D.C., Guam and the Virgin Islands prohibit drivers from using handheld cell phones while driving. No state bans all cell phone use behind the wheel.

Distracted Driving Awareness Month is an opportunity to assess your driving habits. Our Boston car accident lawyers offer a few ways you can reduce distracted driving in the car:

  • Do not talk on your cell phone or text message while driving.
  • If you are tempted to use your cell phone, keep it in a place you will not answer or check it when stopped at intersections.
  • Keep your GPS mounted on the windshield and enter the the address where you are heading before you start your trip. Stop at the side of the road if you need to make adjustments to the GPS.
  • If you are using a printed map, familiarize yourself with your route and plan to make stops.
  • Keep eating and drinking to a minimum.
  • If you are traveling with a child, give them a book to occupy them. If you are traveling with several children, explain how they must behave in the car so you can focus on the road.
  • Do not watch videos.
  • Do not apply make-up, comb your hair or perform other grooming activities
